By accessing or using the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority or do not agree with these Terms, you must not use the Service.
You must register for an Account to access certain features. You agree to provide accurate and complete information and to keep this information updated. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
Subject to your compliance with these Terms, HouseVibes grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business purposes.
Ownership: You retain all ownership rights in your User Content.
License Grant to HouseVibes: By uploading User Content, you grant HouseVibes a worldwide, royalty-free, non-exclusive license to use, host, store, reproduce, modify, and create derivative works of (such as the Output) your User Content solely for the purpose of providing, improving, and securing the Service.
Your Responsibilities: You represent and warrant that you own or have the necessary rights, licenses, and permissions to all User Content you upload. You are solely responsible for your User Content and the consequences of posting or publishing it.
Ownership: Upon payment of all applicable fees, HouseVibes grants you a perpetual, worldwide, non-exclusive, royalty-free license to use, copy, modify, and distribute the Output for any lawful purpose, including for commercial purposes (e.g., marketing a property for sale).
Disclaimer on Output: The Output is generated by artificial intelligence. It is for inspirational and marketing purposes only. The Output does not constitute architectural, engineering, or interior design advice and should not be relied upon as such. HouseVibes does not guarantee that the Output will lead to a sale, lease, or any specific outcome.
You agree not to use the Service to:
You agree to pay all applicable fees as described on the Service. Fees are non-refundable except as required by law or as stated in this Refund Policy.
If you purchase a subscription, it will automatically renew at the end of each billing cycle until you cancel. You can cancel your subscription at any time through your Account settings. Cancellation will take effect at the end of the current billing cycle.
You are responsible for paying any applicable taxes.
8.4.1 General Policy: Due to the digital and immediate nature of our Service, we generally do not provide refunds for fees paid, including for partially used subscription periods. By purchasing a subscription or a one-time service, you acknowledge and agree that you are not entitled to a refund, except as required by applicable law or as explicitly stated in this policy.
8.4.2 Subscription Refunds: If you cancel your subscription, the cancellation will take effect at the end of your current billing cycle. You will not receive a refund for any unused portion of the current billing period.
8.4.3 One-Time Purchase Refunds: For one-time purchases (e.g., a single virtual staging job), refunds may be considered only if the Service has failed to generate the promised Output due to a technical fault on our end, and only if the issue cannot be resolved promptly by our support team. No refunds will be granted for dissatisfaction with the aesthetic quality of the AI-generated Output, for user error, or after the Output has been successfully delivered and downloaded.
8.4.4 Refund Requests: All refund requests must be submitted in writing to info@vastgoedvisueel.nl within 14 days of the transaction, detailing the reason for your request. We will review each request on a case-by-case basis and reserve the sole discretion to determine if a refund is appropriate under the circumstances.
8.4.5 Statutory Rights: This Refund Policy does not affect your statutory rights as a consumer, including any right to a refund for our failure to provide the Service with reasonable care and skill, as required by consumer protection laws in your jurisdiction.
The Service, including its underlying software, algorithms, design, and "look and feel," is the exclusive property of HouseVibes and its licensors. Except for the licenses explicitly granted in these Terms, no rights are granted to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HOUSEVIBES DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSEVIBES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE. IN NO EVENT SHALL HOUSEVIBES'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO HOUSEVIBES IN THE PAST SIX MONTHS.
You agree to indemnify and hold harmless HouseVibes and its affiliates, officers, and employees from any claim, demand, loss, or damage, including reasonable attorneys' fees, arising out of your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.
HouseVibes may suspend or terminate your Account and access to the Service at any time for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by the laws of the Netherlands, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the courts located in the Netherlands.
HouseVibes reserves the right to modify these Terms at any time. We will provide notice of changes by posting the updated Terms on the website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
